Scope of Application

This Policy applies to users of the website (pikup.ch) and the mobile/tablet application in Switzerland, as well as the Pikup Driver application and any other website or application developed by Pikup Sàrl, including any user of Pikup's applications, websites, functionality, or other services. By "user," Pikup specifically includes its Clients, its drivers, and its Partners (especially restaurateurs), as well as its order preparers.

Data Collected

We collect certain personal data (your name, date of birth, gender, language preferences, password hash, postal address, delivery information (door code, floor, etc.), email address, phone number, order history, payment methods used, product and restaurant preferences, customer account information, identifiers on third-party social networks, and communications with you), with diligence and in strict compliance with data protection legislation.

Furthermore, we may collect and process information regarding your use and behavior on our website or applications (session data, your browsing preferences, statistics concerning your visits, device and browser information, IP address, and location data).

By voluntarily submitting personal data, you agree to provide us with truthful, current, and complete data at the time of submission. You are solely responsible for the accuracy of your personal data and must inform us of any changes. We cannot be held responsible for inaccurate data.

Location data (clients): We collect precise or approximate location data from clients' mobile devices if they allow us to do so. Pikup collects this data from the moment they order on the website or application until the order is completed, and when the application is open in the foreground on their mobile device. This data is used to improve the use of the website and application by the Client, including security features, but also to detect and prevent fraud.

Location data (drivers, restaurants, order preparers): We collect this data when the Pikup Driver application or any other relevant website or applications developed by Pikup Sàrl operate in the foreground (the application is open and visible on the screen) or in the background (the application is open but not visible on the screen) on their mobile device. When drivers start a delivery service via the Pikup application, their precise location data must be provided to Pikup. The same applies to restaurateurs and order preparers. Once the application or website developed by Pikup Sàrl has been granted permission to access location services via the authorization system used by their mobile operating system, we may also obtain the precise location of their mobile phone when the application is running in the foreground or background. We collect the data you provide directly when you create or modify your account. This data may include: name, first name, email address, phone number, postal address. This data may be shared with other drivers or order preparers, as applicable.

Internal Messaging

Internal messaging allows drivers to communicate with Pikup, with other drivers, or delivery clients. These conversations are not private between you and your interlocutor: Pikup may at any time consult the histories of your conversations if necessary.

Internal messaging allows you to share photos taken from the application, as well as your precise location (upon your request).

Use of Personal Data

In general, your personal data is only used to respond to your requests, process your orders, communicate with you, optimize our products, website, and applications, monitor your experience, and/or for any other purposes for which the data is provided.

Your personal data is only transmitted to third parties if it is necessary for processing your orders or if you have previously consented to it. Personal data may also be disclosed to third parties when required by law or a court order.

We also reserve the right to use all or part of your personal data for other purposes, such as conducting surveys or recommending products that may interest you. You may at any time partially or fully object to the use of your personal data for such purposes (opting-out) by unsubscribing from the distribution list.

In case of misuse of our website or applications, or if there is a suspicion of punishable acts, personal data may be analyzed to clarify the situation and may be transmitted to competent official authorities or the third party concerned by the abuse.
